Terms of Use

1. Welcome to My Red Rock and thank you for taking the time to read these terms of use, which apply in respect to your use of My Red Rock and all information, services and applications we offer or provide on My Red Rock.
2. For the purposes of these terms of use, "Red Rock" means Red Rock Council.
3. By accessing and using My Red Rock you are deemed to have agreed to these terms of use.
4. The information contained on My Red Rock is provided for the purposes of informing you about Council services, and enables you as a member of the public to undertake certain activities online, including but not limited to; enabling you to pay rates and water bills, apply for permission to perform an activity governed by Council, request a service from Council, view communications and update your contact details (as applicable).
5. While Red Rock Council will endeavour to keep the contents of My Red Rock up to date and accurate, we do not warrant or represent to you or any other person that such content is accurate or up to date at all times.
6. Red Rock will provide My Red Rock and any services that you request with reasonable care and skill, however we do not represent or warrant that My Red Rock or any service will operate on a continuous or fault-free basis or at any particular time or location.
7. We will endeavour to have functionality to My Red Rock restored as soon as reasonably possible in the event of an outage or other technical fault.
8. To the fullest extent permitted by law, Red Rock Council and its officers and employees will not be liable whether in contract, tort (including negligence) or otherwise to you or any other person for any loss or damage (whether direct, indirect, consequential or special) arising directly or indirectly from any errors or omissions in the information contained in My Red Rock or any delay or interruption to or use whatsoever of My Red Rock, or any failure to comply with clauses 6. We are also not responsible for the security of the environment that you choose to access your information.
9. Except as expressly provided otherwise, Red Rock Council or its suppliers own all copyright and other intellectual property rights in the information contained in My Red Rock or otherwise connected with My Red Rock. No part of My Red Rock may be modified, reproduced, transmitted, stored or otherwise dealt with (including in any other website or other electronic form) except as expressly provided for on My Red Rock or with the prior written consent of Red Rock Council, except that you may print, or download to your hard drive extracts from My Red Rock for your own personal use.
10. While using My Red Rock you must ensure that:
    • 10.1. all information which you supply to Red Rock Council is current, complete, accurate and provided in a timely manner;
    • 10.2. you comply with all applicable laws, regulations standards and codes;
    • 10.3. all security information (including any login, username, password or PIN) relating to you is kept confidential and not disclosed to any third party; and
    • 10.4. you notify us immediately of any actual or suspected unauthorised use of security information relating to you.
11. You accept you are responsible for your use of My Red Rock and you are liable for any costs, expenses and damages incurred as a result of any claim brought by a third party against Red Rock Council arising from your use of My Red Rock or a breach of these terms of use. We may suspend or terminate your use of My Red Rock at any time in the event you breach these terms of use.
12. My Red Rock may contain links to other third party sites. These sites are not under the control of Red Rock Council, and Red Rock Council is not responsible for the contents of any linked site or liable for any loss or damage (whether direct, indirect, consequential or special) suffered by you or any other person from accessing, using or relying on any linked site. The inclusion of any link in My Red Rock is provided as a convenience only and does not imply endorsement, recommendation or warranty by Red Rock Council of the linked site or the products and services provided there or any association with its operators.
13. We may change the content of My Red Rock and these terms of use at any time without notice, and any revised terms of use located on My Red Rock from time to time will apply to your use of My Red Rock.
14. For the avoidance of doubt, in the event of any inconsistency between the content on My Red Rock and the terms and conditions of our policies, the terms and conditions of our policies take precedence.
15. The contents of My Red Rock have been prepared in accordance with Australian law. The contents of My Red Rock are governed by Australian law and Australian courts have non-exclusive jurisdiction.
16. All dollar figures stated on My Red Rock are in Australian dollars and include goods and services tax (unless otherwise stated).
